The Marcos Jr. administration has 15 days to seek reconsideration of a Supreme Court ruling declaring unconstitutional several provisions in recent national budgets, a court spokesperson said.
Supreme Court spokesperson Atty. Camille Ting said the decision has not yet become final and executory and remains subject to a motion for reconsideration.
The statement came after Malacañang announced that the government, through the Office of the Solicitor General, is preparing to challenge portions of the ruling.
In its decision, the Supreme Court declared unconstitutional the P449.5-billion increase in unprogrammed appropriations under the 2024 General Appropriations Act and the P17.99-billion additional allocation to the Department of Public Works and Highways’ Special Road Fund in the 2025 budget.
The High Court also struck down several special provisions in the 2026 General Appropriations Act as unconstitutional.
Palace Press Officer and Communications Undersecretary Claire Castro earlier said the administration disagrees with parts of the ruling, maintaining that government actions were undertaken in accordance with existing law.
The Office of the Solicitor General is expected to file a motion seeking a review of the decision within the period prescribed by the Rules of Court.# (TAMMY QUIBRAL)
